Terms & Conditions

Please read these Terms and Conditions carefully.  These Terms and Conditions set out the agreement (the “Agreement”) between the Buyer and Dovecote Décor.  By placing an order with Dovecote Décor, the Buyer agrees to be bound by all of the Terms and Conditions set forth herein.

The terms "you", "your", and "yours" refer to anyone accessing, viewing, browsing, visiting or using this Website (“Website”) – www.dovecotedecor.com.  The terms "Dovecote Decor", "we", "us", and "our" refer to Dovecote Décor.  We reserve the right to change the nature of this relationship at any time and to revise these Terms and Conditions from time to time as we see fit.  As such, you should check these Terms and Conditions periodically.  Changes will not apply to any orders we have already accepted unless the law requires.  Your accessing, viewing, browsing and/or using the Website after we post changes to these Terms and Conditions constitutes your acceptance and agreement to those changes, whether or not you actually reviewed them.  At the bottom of this page, we will notify you of the date these Terms and Conditions were last updated.

The Buyer accepts and agrees to be bound by the following terms and conditions:

  1. Relationship between Buyer and Dovecote Decor
    1. Dovecote Décor acts as an agent for the Buyer, not the Supplier.
      1. “Supplier” refers to any supplier, manufacturer, distributor, vendor or who supplies the product, including their employees, agents, and assigns.
  2. Dovecote Décor does not warehouse or store any products listed for sale through our Website.
  3. Product Availability
    1. Dovecote Décor selects furniture and home décor items at international and regional trade shows, auctions, and flea markets.  Many of the products we select for our Buyers are hand-crafted and custom-made.
    2. Therefore, all products are subject to availability.   Products that are in stock will be available for immediate shipment whereas others may be on backorder.
    3. Product Description
      1. Dovecote Décor will use its best efforts to provide a product description for each product on our website. However, all dimensions are approximate.  And actual leather, fabric, and wood stain colors may vary slightly from the image you see on the computer screen.
      2. When available, Dovecote Décor will include estimated shipping times in the product description.
      3. Product information, availability, prices, and/or specifications are subject to change. 
      4. Payment
        1. The Buyer must pay the full purchase price at the time of purchase.
        2. Order Confirmation
          1. Product listings on our Website are not offers to sell goods, but rather advertisements to receive offers.
          2. Your order constitutes an offer to purchase product(s) through our Website.
          3. After placing an order, you will receive an email from us acknowledging that we have received your order (“Order Confirmation”).
          4. Acceptance of this offer is expressly conditioned upon your express agreement to these Terms and Conditions without modification.
          5. The Order Confirmation does not constitute acceptance by Dovecote Décor and does not guarantee product availability.
          6. The Order Confirmation will include the total purchase price, product name and description, and a reference number.
          7. You must notify us at (336) 705-1316 within one (1) Business Day if the Order Confirmation is incorrect as written.
            1. “Business Day(s)” means Monday through Friday, 8:00am – 5:00pm (EST), excluding U.S. Holidays.
  4. WITHIN ONE (1) BUSINESS DAY OF RECEIVING THE ORDER CONFIRMATION, YOU ACKNOWLEDGE THAT YOU HAVE SEEN AND AGREE TO THE PRODUCT DESCRIPTION, PRICE, AND SPECIFICATIONS AS WRITTEN.
  5. After receiving your order, Dovecote Décor will call the Supplier to check on the availability of the item and to obtain an estimated shipping time.
  6. Shipping Confirmation
    1. Dovecote Décor will accept your order by sending you an email confirming the shipment of your order (the “Shipping Confirmation”).
    2. A contract with us will be formed when we send you the Shipping Confirmation. 
    3. In the Shipping Confirmation, Dovecote Décor will provide the estimated shipping date and the name and contact information of the Carrier.  We may provide other information relevant to shipping and delivery, such as a link to the Carrier’s website, where you can track shipment.
    4. It is your responsibility to read the shipment, delivery, and insurance terms and conditions supplied by the Carrier.
    5. Cancellation Policy
      1. If the product(s) are available at the time of the order and there have been no material changes in availability, price, or specifications, the order will be deemed final and subject to our Repair & Replacement Policy.
      2. Backordered Products.  If the product(s) are backordered, Dovecote Décor may, in its sole discretion, permit you to cancel the order.
        1. Within one (1) Business Day, Dovecote Décor will notify you by phone if your product is on backorder and, if the information is available, will notify you of the expected availability and shipping date(s).  If we cannot reach you at the number provided, your right to cancel remains in effect for one (1) Business Day from the date of notification.
          1. Thus, if you elect to cancel, you must cancel within one (1) Business Day of the date of backorder notification and must cancel by calling Dovecote Décor.
          2. If you elect to cancel, Dovecote Décor may request that you send a written notice of cancellation.
          3. Your cancelled order is subject to our Refund Policy.
    6. After one (1) Business Day, Dovecote Décor, in its sole discretion, may place the order with the Supplier.  Thus, if the item is on backorder, and Dovecote Décor cannot reach you to discuss the backorder within one (1) Business Day, Dovecote Décor may place the order with the supplier. 
    7. Once this order is in place, you will be subject to our Repair & Replacement Policy.
  7. Material Changes in Price or Specifications.  If there have been material changes in price or specifications, Dovecote Décor may, in its sole discretion, permit you to cancel the order.
    1. Within one (1) Business Day, Dovecote Décor will notify you by phone of any changes in price or specifications.  If we cannot reach you at the number provided within one (1) Business Day from the date of notification, then Dovecote Décor will cancel your order.
    2. If you elect to cancel, Dovecote Décor may request that you send a written notice of cancellation.
    3. Your cancelled order is subject to our Refund Policy.
  8. Discontinued Products. If the product has been discontinued or is otherwise completely unavailable, Dovecote Décor will permit you to cancel the order.
    1. Within one (1) Business Day, Dovecote Décor will notify you by phone that your ordered product has been discontinued or is completely unavailable.  If we cannot reach you at the number provided, your order will be cancelled.
    2. Your cancelled order is subject to our Refund Policy.
    3. Refund Policy.
      1. If your order is cancelled, in accordance with the terms and conditions set forth in Section VII, your credit card charge will be voided or credited back in the original form of payment used when the order was placed.
      2. If your order is cancelled because of supplier bankruptcy or insolvency, Dovecote Décor will attempt to recover funds from the supplier.  If Dovecote Decor is unsuccessful recovering funds, we will guarantee, at a minimum, to refund any part of the price paid in excess of the supplier's price, including any shipping costs.
      3. Fees & Taxes 
        1. All products are fully insured through the Carrier.
        2. All products ordered through Dovecote Décor and delivered to locations in North Carolina will be subject to the sales tax applicable in your county. 
        3. Shipping & Delivery
          1. Dovecote Décor buys the product directly from the Supplier. 
          2. Excepting smaller items, all orders will by shipped through a White Glove Delivery service.
            1. “White Glove Delivery” refers to a Carrier that handles, places, and assembles the product inside your home or other designated location.
  9. Most Suppliers arrange for shipping and delivery through their preferred Carrier, or the best available Carrier.  In other cases, Dovecote Décor will arrange for shipment and delivery through the best available Carrier.
  10. Dovecote Décor will only ship to the 48 contiguous states in the United States.
  11. White Glove Delivery
    1. All shipping and delivery dates and times are received directly from the Supplier and are not guaranteed.
    2. The Carrier will call you in advance at the number you provided to schedule a date and time for delivery.
    3. A signature will be required at the time of delivery.
    4. Under no circumstances will the Carrier leave orders at your doorstep.
    5. The Carrier will have its own policy regarding handling, placing, and assembling furniture and other items.
  12. Shipping & Delivery for Smaller Items
    1. For smaller items, Dovecote Décor may arrange for shipping through UPS, FedEx, or the best Carrier available.
    2. A signature will be required at the time of delivery.
  13. Buyer’s Obligations Prior to Delivery
    1. If the Carrier does not provide you with their shipping and delivery terms and conditions it is your responsibility to ask the Carrier about their terms and conditions. 
    2. For example, for most furniture items, the Carrier may require the Buyer to measure all stairwells, hallways, doorways, and elevators to ensure adequate clearance.  Also, most Carriers require that the Buyer keep all original packaging.
    3. REPAIR AND REPLACEMENT POLICY
      1. Unless otherwise specified in this Agreement, in the Supplier’s terms and conditions, or on the delivery receipt or packing slip, Dovecote Décor will not accept returns.  Nor can Dovecote Decor guarantee that the Supplier will accept returns.
      2. Our staff is available to help you if your order is damaged, defective, or does not conform to your Order Confirmation.  At a minimum, we will provide you with the Supplier’s return policy and assist you in the process of obtaining a repair and replacement as soon as possible.
      3. If you receive damaged, defective, or non-conforming goods:
        1. you must notify Dovecote Décor by phone within five (5) Business Days of receipt of the order; and
  14. If you receive damaged, defective, or non-conforming goods:
    1. Dovecote Décor will contact the Supplier on your behalf;
    2. the repair or replacement will be handled by the Supplier or the Carrier;
    3. the Supplier may require that you submit your claim directly to the Carrier; and
    4. It is your responsibility to keep all original packaging materials and to keep the item in unused condition.
  15. REPAIR AND REPLACEMENT PROCEDURE
    1. Damaged or Defective Goods – Buyer’s Responsibilities
      1. “Damaged” or “Defective” goods refer to orders with damages or defects noticeable upon inspection, including but not limited to tears, stains,
      2. At the time of delivery, the Buyer must carefully inspect the order to ensure that there is no damage or defect.
      3. AT THE TIME OF DELIVERY, YOU MUST NOTIFY THE CARRIER OF ANY DAMAGE OR DEFECT THAT CAN BE OBSERVED UPON INSPECTION.
      4. BEFORE THE DELIVERY PERSON(S) LEAVE, YOU MUST NOTE ANY DAMAGE OR DEFECT ON THE DELIVERY RECEIPT.
      5. IF YOU FAIL TO MAKE NOTE OF THE DAMAGE OR DEFECT, YOU MAY BE DEEMED TO HAVE ACCEPTED THE GOODS IN THE CONDITION DELIVERED AND YOU MAY WAIVE YOUR RIGHT TO FILE A CLAIM WITH THE CARRIER.
      6. IN ADDITION, IF YOU RECEIVE DAMAGED OR DEFECTIVE GOODS, YOU MUST CONTACT US WITHIN FIVE (5) BUSINESS DAYS. 
    2. Non-Conforming Goods – Buyer’s Responsibilities
      1. “Non-Conforming” goods refer to orders that do not conform to the product description as written on the Order Confirmation.
      2. At the time of delivery, the Buyer must carefully inspect the order to ensure that the order conforms to the written order confirmation.
      3. IF YOU RECEIVE NON-CONFORMING GOODS, YOU MUST CONTACT US WITHIN FIVE (5) BUSINESS DAYS. 
      4. If your receipt of non-conforming goods is a result of our own error, Dovecote Décor will be fully responsible for processing the return, delivering a replacement product, and paying all return shipping and related costs.
      5. Force Majeure
        1. Delivery is contingent upon all supply channels being available and timely. Dovecote Décor is not responsible for any delays or failure to deliver, when such delay or failure is caused by events outside of our control.
        2. Warranty and Warranty Disclaimer
          1. Some states do not allow limitations on implied warranties, so the above disclaimers may not apply to you.
          2. Limitation of Liability
            1. IN NO EVENT WILL DOVECOTE DÉCOR BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY OTHER ECONOMIC LOSS ARISING FROM BREACH OR ANY OTHER CLAIM ARISING OUT OF OR RELATED TO YOUR PURCHASE OF ANY PRODUCT LISTED FOR SALE ON THIS WEBSITE.
            2. Dispute Resolution
              1. You and Dovecote Décor agree to resolve any controversy, dispute, or claim arising out of or related to your purchase of any product listed for sale on this website by binding Arbitration administered by the American Arbitration Association.
              2. This agreement to arbitrate is intended to be broadly interpreted and covers all controversies, disputes, or claims arising out of or related to your purchase, including but not limited to contract, tort, and statutory claims.
              3. You and Dovecote Décor agree that the arbitration will take place in Forsyth County, North Carolina.
              4. Governing Law
                1. This Contract is governed by the laws of the State of North Carolina.

 

These Terms and Conditions are effective as of December 15, 2010.
